How We Keep It Safe

Liminal Clinic is committed to protecting your privacy and ensuring that your personal and sensitive information is handled in a secure and responsible manner. This Privacy Policy outlines how we collect, use, disclose, and protect your personal and sensitive information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

This includes overseeing policy reviews, conducting Privacy Impact Assessments (PIAs) for new services or technologies (such as AI tools), ensuring regular and comprehensive staff training on privacy obligations, and responding to all privacy inquiries and complaints.

We integrate privacy considerations into the design and implementation of every new service, system, and process we adopt (a "Privacy-by-Design" approach). This involves undertaking regular reviews and internal audits to proactively identify and mitigate privacy risks, ensuring your information is protected from the very beginning.

3. Key Definitions 

  • Personal information: personal information is any information or opinion about an individual that can identify them. This includes but is not limited to names, contact details, medical history, and other health-related information.

  • Sensitive Information: A special category of personal information requiring extra protection. This includes health information (like your medical history, session notes, and treatment details), racial or ethnic origin, political opinions, religious beliefs or affiliations, sexual orientation or practices, or criminal record. Due to the nature of our psychological services, we routinely collect sensitive information.

  • De-identified: Information from which all direct personal identifiers (like your name or date of birth) have been removed. While it might theoretically be possible to link this data back to you through other means (e.g., by combining with other data sets), we implement strict controls to prevent this.

  • Anonymised: Information that has been irreversibly processed so that you can no longer be identified from it, directly or indirectly. Anonymised data cannot be traced back to you.

  • APPs: Australian Privacy Principles, which are the core rules governing how Australian government agencies and many private organisations handle personal information under the Privacy Act 1988 (Cth).

  • Billing and Rebates Information: Insurance details, payment history, and other financial information.

  • Consent & Communication Records: Documentation of any consents you provide for treatment, disclosure of information, or other purposes, as well as records of all communications with us (e.g., emails, phone calls, online chat, Hiver queries).

  • Recruitment Data: If you apply for a position with us, we gather information relevant to your employment application, such as your CV, qualifications, and references.

  • Website Usage: Information about your interactions with our websites (e.g., IP address, device/browser information, referral source, pages viewed, and time spent on our sites), collected through cookies and similar technologies.

We collect personal and sensitive information directly from you, such as during consultations, through forms, or via telephone and email. In some cases, we may also collect information from third parties, such as other healthcare providers, with your consent.

How We Gather:

  • Directly from You: This is our primary method. We collect information when you interact with us in person, via phone or email, through online forms (e.g., contact, registration, purchase, psychological screening forms), during your psychological sessions, or when you provide details for billing or rebates.

  • With Your Permission: We may gather information from third-party referrers (e.g., your GP or other health professionals) when you have provided us with your explicit permission to do so.

  • Automatically: Information about visitors to our websites (www.liminalclinic.com.au, www.brydanxavier.com.au, and other affiliated websites) is collected automatically through website analytics, cookies, and other tracking technologies.

6. Use of Personal and Sensitive Information

We collect, hold, use, and disclose your personal information for the following purposes:

  • Providing Healthcare Services: To provide psychological services, conduct assessments (including screenings and questionnaires), develop tailored treatment plans, and support your therapeutic journey.

  • Administrative & Billing Purposes: To handle appointments, billing and communications. 

  • Care Coordination: To communicate with your referrer or other health professionals (e.g., GP, psychiatrist, therapist) with your informed, written consent, to ensure integrated care.

  • Improving Services: To understand client needs, enhance our services, and conduct internal research and analysis. When information is used for research, it is de-identified or anonymised wherever possible.

  • Marketing and Engagement: To inform you about services, workshops, or resources where you have opted to receive such communications. You can opt out at any time.

  • Legal and Compliance: To comply with legal, ethical, and professional requirements under relevant laws and standards (e.g., Privacy Act, APS Code, PsyBA, Medicare, NDIS), including mandatory reporting obligations where there is serious and imminent risk of harm. This includes, but is not limited to:

  • Court Subpoenas: If legally compelled by a court order or subpoena.

  • Mandatory Reporting: To comply with mandatory reporting obligations (e.g., child protection concerns, reportable conduct schemes).

  • Funding Body Claims: To process rebates or funding for your treatment, we are required to share relevant information with Medicare, the NDIS, or other funding bodies. This includes audits, and may involve sharing information necessary to establish your eligibility and process claims.

  • Safety & Duty of Care: To prevent or lessen a serious and imminent threat to the life, health, or safety of yourself or another identifiable person, or to protect the public.

  • Recruitment: If you apply for a role with us, to assess your suitability and manage the recruitment process.

We do not use your personal and sensitive information for any purpose other than those outlined above without your consent, unless required or permitted by law.

6. Disclosure of Personal and Sensitive Information

We may disclose your personal and sensitive information to:

  • Healthcare Providers: Other medical professionals involved in your care.

  • Government Bodies: For compliance with legal or regulatory requirements.

  • Service Providers: Third parties who perform services on our behalf, such as IT support or billing services. These providers are contractually bound to strict confidentiality and privacy obligations, or operate under their own robust privacy policies that align with Australian privacy standards.

  • Insurance Companies: For processing claims and payments.

  • Our Employees and Contracted Staff: Our employees and contracted staff (including practitioners, administrative staff, and IT support) may be required to access your information to assist in providing services to you and for other activities directly related to the safe and effective operation of Liminal Clinic. All staff are bound by strict confidentiality agreements and professional ethical guidelines.

  • Other Third Parties With Your Consent: We will only communicate with other professionals (e.g., your GP, psychiatrist, family members, or other health providers) or disclose specific information to third parties outside the above situations (e.g., for reports) with your explicit, informed, and written / verbal consent.

  • Clinical Support: When consulting with other professionals for clinical supervision or peer review to enhance your care or our professional development. In these cases, all identifying details are removed or sufficiently de-identified to protect your privacy, and we will seek your consent to do so.

  • To Related Entities: Information may be shared between the various trading names and related entities of Liminal Clinic for the purposes outlined in this policy, ensuring consistent service delivery and internal administration.

  • Business Changes: In the unlikely event of a merger, acquisition, or sale of all or a portion of our assets, some or your personal or sensitive information may be transferred to the acquiring entity, within the bounds of ethical and legal requirements. You will be notified of such an event and your rights regarding your data.

We take all reasonable steps to ensure that third parties to whom we disclose personal information are also committed to protecting your privacy and comply with the APPs or similar robust privacy standards.

8. Keeping Data Safe & Retention: Security of Personal and Sensitive Information

We are committed to protecting your personal information with industry-standard security measures throughout its lifecycle. We take reasonable steps to protect your personal and sensitive information from misuse, interference, loss, and unauthorised access, modification, or disclosure. This includes:

  • Physical Security: Secure storage of physical records.

  • Electronic Security: Protection of electronic data through encryption and secure access controls.

  • Staff Training: Ensuring our team understands their obligations regarding your privacy.

Security Measures: Your information is primarily held securely in digital formats (e.g., encrypted cloud services, secure servers, practice management systems). 

Personal and health information is not stored long-term at our practice locations. If hard copy information is received, we digitise it and store it appropriately in our secure digital systems. Hard copies are either returned, destroyed or securely stored in lockable cabinets.

  • Where possible, we avoid attaching documents containing personal information directly to emails. Instead, we provide access through shared links to secured shared drives, and use password-protected documents for sensitive information.

  • Any devices used by staff that may temporarily access or process personal information are secured using Multi-Factor Authentication (MFA) or other bio-security measures (e.g., fingerprint or retina scan).

  • We use shared drives with strict user group permissions and security controls to limit access to information on a need-to-know basis.

  • Our company policy mandates the use of MFA within one week of commencing employment. Passwords are required to be at least 14 characters long, changed regularly, and previous passwords cannot be reused. These password policies are enforced within our Google Workspace and similarly across other systems.

  • We conduct regular audits of our workspace, and implement restrictions and enforcement across applications, ensuring a secure digital environment.

Breach Notifications: 

  • In the unlikely event of a data breach that is likely to result in serious harm, we have a comprehensive Data Breach Response Plan in place. 

  • We will act in accordance with this plan and the Notifiable Data Breaches (NDB) scheme under the Privacy Act, which requires us to notify affected individuals and the Office of the Australian Information Commissioner (OAIC) within 30 days of becoming aware of the reportable breach. 

  • Our Privacy Officer is the key contact in this process.

Data Retention and Disposal: 

  • We retain records for the minimum period required by relevant Australian legislation and professional guidelines, specifically in compliance with the Psychology Board of Australia (PsyBA) Code of Conduct and Australian Psychological Society (APS) Ethical Guidelines that dictate how long to hold information based on client age and other factors. 

  • For psychological records, this is generally 7 years after the last client contact for adults, or until a client who was a minor turns 25 years of age. After this period, records are securely and permanently destroyed or anonymised to protect your privacy. This includes the secure disposal of any physical records using diamond shredders.

9. Your Privacy Rights

Under the Australian Privacy Principles, you have significant choices and control over your personal and sensitive information:

Access:

You have the right to access your personal and sensitive information held by us. To request access or make corrections, please contact us / our Privacy Officer using the details provided below. We will respond to your request within a reasonable timeframe (generally 30 days) and in accordance with the Privacy Act 1988 (Cth). 

Please note that an administrative fee may apply for providing extensive copies of large files, which covers our costs for retrieval, collation, and secure delivery. In some circumstances, access may be refused if granting it would pose a serious threat to the life, health or safety of any individual, or if it would have an unreasonable impact on the privacy of other individuals.

Correction:

You have the right to correct your personal and sensitive information held by us.

To request access or make corrections, please contact us using the details provided below. We will respond to your request within a reasonable timeframe. If you believe that any personal and sensitive information we hold about you is inaccurate, incomplete, out-of-date, irrelevant, or misleading, please contact our Privacy Officer in writing with the details. 

We will take reasonable steps to correct the information. If we disagree with your request, we will provide you with a written explanation of our reasons for not correcting it and may associate a statement with the information noting that you believe it is inaccurate. In some cases, and due to system limitations, we may not be able change existing information, but instead add a file note to correct the information. 

Deletion:

You may request the deletion of your personal and sensitive information where lawful. However, please note that we are subject to strict professional and legal obligations (e.g., professional guidelines, Medicare requirements) that mandate the retention of health records for specific periods.

We will advise you if your request for deletion cannot be fulfilled due to these mandatory retention requirements.

Withdraw Consent:

You can change your mind and withdraw your consent for certain uses or disclosures of your personal and sensitive information at any time, particularly for uses beyond the core provision of psychological care (e.g., marketing communications).

Please note that withdrawing consent for core service delivery may impact our ability to provide you with services.

If you have concerns about how your privacy has been handled, you have the right to make a complaint. Please see the Complaints section for our internal and external complaint resolution process.

At Liminal Clinic, we transparently embrace technology and Artificial Intelligence (AI) to assist us in making mental health support more accessible, efficient, and of higher quality for our clients.

Our use of AI is driven by a commitment to safe and responsible practices, aligning with the Psychology Board of Australia (PsyBA) Code of Conduct, the Australian Privacy Principles (APPs), and other relevant legislation, guidelines, and best practices regarding AI use in healthcare.

  • Analytics for insights: Identifying and understanding insights within structured and unstructured materials via data analysis (e.g., from client assessments or outcome measures).

  • Workplace productivity: Automating routine tasks, managing workflows, and facilitating communication (e.g., for scribing, dictation, general note-taking assistance, or generating draft communications).

  • Service delivery: Enhancing the efficiency and accuracy of our services by providing tailored support to clients or supporting staff who deliver services (e.g., AI agents assisting with customer service queries or psychological screening).

  • Domains of Application: Our AI use primarily applies within the domains of:

  • Scientific: Leveraging AI for complex data processing in psychological assessments and research.

  • Service delivery: Direct application of AI to improve the delivery and accessibility of our psychological services.

  • Corporate and enabling: Supporting our administrative and operational functions.

10b. Management & Safeguards:

  • We adhere to a strict policy to never input personally identifying client information into public AI services, or into any AI tool where such information could be used to train public models, without appropriate safeguards and explicit client consent.

  • Any use of AI tools for processing client data is subject to rigorous ethical review and internal protocols.

  • Where personal information is involved in AI-assisted processes, it is de-identified or anonymised to the greatest extent possible prior to input.

  • We continuously monitor and assess the privacy and security practices of our AI service providers to ensure they meet our high standards and comply with relevant Australian privacy laws.

10c. Our Commitment to Safe and Responsible Use:

  • We are dedicated to ensuring that AI systems are used in a manner that is fair, accountable, and promotes the well-being of our clients. Human oversight is maintained for all AI-informed outputs that directly impact client care.

  • All AI use within Liminal Clinic is conducted in strict compliance with this Privacy Policy, the Privacy Act 1988 (Cth), the PsyBA Code of Conduct, the APS Code of Ethics, and other applicable legislation and guidelines governing the use of technology and AI in healthcare.

11. The Tools We Use

To enhance your care, ensure data security, and streamline our services, we partner with a range of secure, reputable digital tools and systems. The security and privacy practices of these third-party providers are carefully assessed to align with Australian privacy standards.

  • Practice & Records Systems: Our primary client management and practice management system is Splose. We also use Halaxy as a legacy practice management system. 

  • Clinical assessments are supported by NovoPsych & NovoScribe Pro and PariConnect.

  • Finance and Payment Systems: We may use the following for accounting, financial management and payment and rebate processing:

    • Xero

    • Stripe

    • Tyro Health (previously MediPass)

    • HealthPoint (Tyro Health)

  • Communication & Customer Service:

    • We use Google Workspace (Gmail, Google Docs, Google Sheets, Google Drive, Google Meet) and Microsoft 365 (MS Teams) for secure internal communication, document management, and collaboration.

    • Slack is used for internal team communication.

    • Mailchimp is used for optional newsletters and marketing communications.

    • VonexVoiP for telephony.

    • Get Guru, Scribe, and Loom for internal knowledge sharing and training.

    • Asana for project management.

    • HubDoc for document processing.

    • HubSpot for customer relationship management.

    • Hiver for customer service and managing queries.

  • AI-Assisted Tools (specific tools that utilise AI functionalities):

    • HeidiHealth, NovoScribe, ChatGPT Pro, Google Gemini AI, and ANTSA are used for purposes as described, such as documentation, scribing, dictation, note-taking, psychological screening, and AI assisted support between sessions.

  • Online Presence & Client Interaction:

    • Our websites are hosted on Squarespace and Wix. These platforms may also be used to host client portals, hubs, or similar features, and information may be used to create and provide these services.

    • TypeForm and JotForm may be used for online forms, surveys, and collecting information for psychological screening and other client intake processes.

    • Our primary telehealth platform is Google Meet, with backups including MS Teams.

    • Domain management is handled by Crazy Domains and GoDaddy.

  • Security & Support:

    • Zapier for automation between applications.

    • ANTSA for various supporting functions including AI support between sessions.

    • AirTable for flexible database management.

    • Canva and Designrr for content creation.

    • ScanSnap for document scanning

12. Our Website, Cookies & Third Parties

Our websites (www.liminalclinic.com.au, www.brydanxavier.com.au, and other affiliated websites) use "cookies" and similar tracking technologies to enhance your browsing experience, analyse website traffic, and understand user behaviour.

  • Analytics: We use analytics tools (e.g., Google Analytics via Squarespace, Wix, Diib) to collect non-personally identifiable information about how visitors use our sites. This helps us to improve our website design and content.

  • Other Tracking Technologies: May include web beacons, pixels, and other technologies to track interaction with our website and email campaigns.

  • Cookie Settings: You can manage cookies via your browser controls or our website's cookie banner.

  • Third-Party Services: Our websites may contain links to third-party websites or services that are not operated by us. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies when you visit them. 

13. Overseas Transfers

Some of our digital tools and cloud service providers (e.g., Google Workspace, Halaxy, Mailchimp, Stripe, Microsoft 365, Squarespace, Wix, various AI tools, JotForm) may use servers or operate in overseas locations. This means that, in limited circumstances, your personal information may be transferred to, or accessed from, countries outside of Australia. For example, some data may be processed in the United States (e.g., Mailchimp) or Europe (e.g., Google, Stripe).

We take reasonable steps to ensure that any overseas recipient does not breach the Australian Privacy Principles (APPs) in relation to the information, or that they are subject to a law or binding scheme that has the effect of protecting the information in a way that is substantially similar to the APPs (e.g., via robust contractual agreements, Standard Contractual Clauses, or specific adequacy findings where applicable). By engaging with our services and providing your information, you consent to this possibility of overseas disclosure.

14. Children’s Privacy

Our psychological services are primarily directed towards adults and adolescents. 

While we generally do not knowingly collect personal information from individuals under the age of 13, if we do need to collect such information, we will do so only with verifiable parental or guardian consent, in accordance with Australian law and ethical guidelines.

We are committed to resolving any concerns you may have about your privacy. 

If you believe that we have breached your privacy or mishandled your personal and sensitive information, you can lodge a complaint with us. Please contact us with the details of your complaint, and we will investigate and respond as soon as possible.
